This Terms of Service Agreement (“Agreement”) is entered into between Ai EngineHost (“we,” “us,” or “Ai EngineHost”) and you (“Client,” “you,” or “your”) and governs your access to and use of our services and the aienginehost.com website (collectively, the “Services”).

By using our Services, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement.

Acceptable Use

Our Services may be used only for lawful purposes. All users must comply with applicable laws and regulations of the United States of America. By using our Services, you agree to indemnify and hold Ai EngineHost harmless from any claims, losses, or damages resulting from your use.

You must be at least 18 years of age to access or use our Services. By using the Services, you confirm that you meet this requirement. If you are accessing the Services on behalf of another party, you confirm that you are authorized to bind that party to this Agreement.

Prohibited Activities

You may not use our Services to violate any laws or infringe on the rights of others. The following are strictly prohibited:

  • Infringement of copyrights or trademarks (e.g., unauthorized copying or distribution of music, books, images, or other protected works)
  • Offering or selling counterfeit goods
  • Hosting or linking to illegal content, Porn Sites, pirated software (Warez), or malicious scripts
  • Use of proxy scripts, anonymizers, IRC bots, or IP scanners
  • Hosting of mail bombers, spam tools, brute force applications
  • Sites that promote illegal activities, fraud, gambling, or controlled substances without valid documentation
  • Use of shared accounts for file dumping, massive storage, or backup purposes

All content hosted must relate directly to your active website(s). Our shared hosting cannot be used for standalone file storage, media storage, or email backups. Hosting download mirrors is not permitted.

Account Security

You are responsible for the security of your account, including managing access credentials. Any software/scripts installed under your account must be kept up to date and secure. Always use strong passwords, and set file permissions conservatively (e.g., directories should generally be set to 755).

You agree that Ai EngineHost has the right to access, store, and manage your content solely for the purpose of delivering Services. We reserve the right to remove any content that violates this Agreement.

We also reserve the right to monitor usage to ensure compliance with these terms.

Copyright & Trademark Violations

If you believe your copyrighted work or trademark is being infringed upon through our Services, please contact us immediately at insourcesoft99@gmail.com with relevant documentation. We respond promptly to all valid DMCA or infringement claims and may disable or remove the content or terminate the violating account.

Repeat offenders may be permanently suspended.

No Backup/Storage Abuse

Using shared hosting accounts solely as storage or backup locations is not allowed. You may store one backup of your account, but multiple backup layers or repeated backups of backups are not permitted.

Zero-Tolerance SPAM Policy

We enforce a strict zero-tolerance policy against SPAM, including but not limited to:

  • Sending unsolicited emails
  • Using or selling purchased mailing lists
  • Engaging in bulk mailing or “safe list” email campaigns

Violations may result in immediate termination of your account without notice. Additionally, you may be charged a $250/hour consulting fee for any necessary remediation efforts required to repair damage to our network or IP reputation, including blacklisting or blocklisting events.

We may implement SMTP filtering as a preventive measure on accounts flagged for abuse to maintain the integrity of our network.

Website and Server Transfers

Our Support Engineers are happy to assist with moving your website or server to Ai EngineHost. Please note that transfers are offered as a courtesy service, and we do not guarantee the success, timing, or possibility of a full or partial transfer. Hosting platforms differ widely, and some use unique systems that may make data migration difficult or impossible.

In certain cases, we may not be able to assist with transfers from other providers. Ai EngineHost is not liable for any lost or missing data during any transfer process. You are solely responsible for backing up your data and verifying its integrity once we notify you that the migration is, to our knowledge, complete.

Backups & Data Responsibility

Using Ai EngineHost services is at your own risk. While our servers are configured with RAID mirroring for additional redundancy, we do not create or maintain customer backups. It is your responsibility to manage and back up all data stored on our servers. Ai EngineHost is not responsible for any data loss or corruption.

Unlimited Hosting Policy

We offer unlimited disk space and bandwidth on Shared, Business, Reseller, and White Label Reseller plans, strictly for hosting files relevant to your website(s).

If a client’s usage consistently causes performance issues, we may require an upgrade to a higher plan. If no action is taken after multiple notices, we reserve the right to suspend the service to maintain server health and performance.

Please note: To protect our platform from misuse or abuse, we’ve implemented a temporary domain limit on all new accounts. This is a security measure based on past user experiences to ensure a safe and stable environment for every customer.

We want to make sure all users enjoy smooth and fair performance, and this initial limit helps us detect and prevent potential abuse.

Once you begin using your hosting account, our security team will monitor and review your activity. If your usage complies with our terms and policies, your domain limit will be automatically increased or fully unlocked — giving you the unlimited access you were promised.

We truly appreciate your understanding and cooperation as we work to protect all our users and deliver the best possible hosting experience.

Respect Policy

At Ai EngineHost, we treat our clients with respect and expect the same in return.

If a client is found being abusive or disrespectful towards our team, we may request that they migrate to another hosting provider within 7 days. After this period, we reserve the right to terminate the account without a refund. Any refund for prepaid services will be at our discretion.

Server & Customer Abuse

Any attempt to compromise the integrity of Ai EngineHost servers or abuse another client’s services will result in immediate account termination, no refunds, and a permanent ban from our platform.

Service Changes & Agreement Updates

Ai EngineHost reserves the right to modify or discontinue services or update this Agreement at any time. A 30-day notice will be posted on our website prior to any major changes. Continued use of our services after that time constitutes your acceptance of the updated terms.

  • Account Termination
  • We may terminate your account and delete all associated data without notice if:
  • You fail to make payment
  • You violate any terms of this Agreement
  • Your behavior risks harming our services, reputation, or staff
  • You engage in abuse or unlawful activity
  • Or any other reason deemed valid by Ai EngineHost

No refunds will be issued for terminated accounts, and you remain responsible for all charges incurred before termination.

Chargebacks & Payment Disputes

If we receive a chargeback or dispute related to your account, all services will be suspended immediately. If not resolved promptly, this may lead to permanent termination of your services.

Reseller Hosting Terms

All content hosted by our Reseller clients must comply with this Agreement. These terms apply equally to Reseller clients and their customers.

Ai EngineHost VPN - DMCA & Legal Policy

Copyright Infringement & DMCA Compliance

Ai EngineHost does not support or permit the use of its services for copyright infringement. We fully comply with U.S. copyright laws, including the Digital Millennium Copyright Act (DMCA).

Ai EngineHost offers an automated VPN service. Our system is designed with privacy in mind — we do not log user activity, access, store, or alter any data transmitted through our network. We do not determine recipients or content accessed by our users. As such, we qualify as a provider of “transitory digital network communications” under 17 U.S.C. § 512(a) of the Copyright Act.

Since we neither store content nor track user activity, we cannot remove allegedly infringing materials or identify specific users involved in potential copyright violations. However, we are committed to cooperating with rights holders who submit valid and complete DMCA takedown notices.

If you are a copyright holder and believe your rights are being infringed via Ai EngineHost services, please consult a qualified attorney to confirm the violation and then submit a proper DMCA notice to our designated agent.

Disclosure to Law Enforcement

Ai EngineHost may disclose subscriber information to law enforcement agencies upon lawful request, without prior notice to the user. We will cooperate fully with official investigations.

Ai EngineHost Proprietary Content

Unless otherwise provided by the Client, all content available through Ai EngineHost services — including designs, text, graphics, images, videos, software, and data — is the exclusive property of Ai EngineHost. This content may not be copied, modified, distributed, transmitted, or used in any form without prior written permission, except as expressly permitted in this Agreement. Reverse engineering or extraction of source code is strictly prohibited.

Prohibited Persons & Sanctioned Countries

In compliance with U.S. regulations enforced by the Office of Foreign Assets Control (OFAC), Ai EngineHost services are not available to users in sanctioned countries or to individuals and entities listed as “Specially Designated Nationals” (SDNs). Use of our services in connection with ccTLDs for such countries is also strictly prohibited.

HIPAA Disclaimer

Ai EngineHost is not HIPAA-compliant. Our services are not intended for the storage or handling of sensitive personal data, including health-related information. Clients are solely responsible for ensuring compliance with any applicable laws. Ai EngineHost disclaims any liability related to the handling of Protected Health Information (PHI) and is not considered a Business Associate under HIPAA.

Disclaimer of Warranties

Ai EngineHost disclaims all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. We are not responsible for business losses, including data loss, delays, service interruptions, or errors.

In no event shall Ai EngineHost or its directors, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages — including loss of profits or data — even if advised of the possibility of such damages.

Our maximum liability, regardless of the cause or form of action, is limited to the amount paid by you for the services in the three (3) months prior to the claim.

Indemnification

You agree to indemnify and hold harmless Ai EngineHost, its affiliates, and associated personnel from any claims, losses, or damages arising from your use of the services, violation of this Agreement, or any unlawful actions.

Arbitration Agreement

Any dispute arising from or relating to this Agreement shall be resolved through binding arbitration by the American Arbitration Association (AAA) in Washington. The arbitration will be conducted by a single arbitrator appointed by Ai EngineHost.

Class actions and joint claims are not permitted. The Federal Arbitration Act governs this clause. You may be eligible for a fee reduction if arbitration is proven to be cost-prohibitive.

If you file legal proceedings in violation of this clause, you agree to reimburse Ai EngineHost for legal fees incurred in enforcing this provision.

Governing Law & Jurisdiction

This Agreement is governed by the laws of the State of Washington. Any claims or disputes will be handled exclusively under these laws. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Disclaimer

Ai EngineHost shall not be held liable for any damages that may impact a Client’s business. This includes, but is not limited to, data loss resulting from delays, missed or incorrect deliveries, or any interruptions in service caused by Ai EngineHost or its Clients. Ai EngineHost provides its services on an “as-is” basis and makes no warranties—express or implied—regarding the services offered. This includes any implied warranties of merchantability or fitness for a particular purpose.

Under no circumstances shall Ai EngineHost, its directors, employees, or agents be liable to you or any third party for any indirect, consequential, incidental, special, exemplary, or punitive damages, including but not limited to, loss of profits or data resulting from your use of the services, user-generated content, user websites, or any other materials accessed or downloaded through the services—even if Ai EngineHost has been advised of the possibility of such damages.

Regardless of anything stated herein to the contrary, Ai EngineHost’s total liability to you, or any party acting on your behalf, for any claim arising out of or related to the services shall not exceed the total amount you paid to Ai EngineHost for those services during the three (3) months preceding the event that gave rise to the claim. This is a cumulative limitation, and multiple claims will not expand this limit.

Entire Agreement

This document, along with any referenced materials, constitutes the complete agreement between you and Ai EngineHost, superseding all previous agreements and discussions regarding the subject matter.

Terms Of Service
